What is probate?

Probate is a grant issued by the Supreme Court of NSW confirming the executor’s authority to administer the deceased person’s estate under their will. A grant is not required for every estate; whether one is needed depends on the assets and the requirements of the organisations holding them.

How we can help

  • Review the will and death certificate, identify the executor who will apply, and assess whether probate is required.
  • Gather details of the estate’s assets and liabilities and prepare the application and supporting material.
  • Publish the notice of intended application on the NSW Online Registry and allow at least 14 days before filing.
  • Lodge the application through the NSW online probate service and respond to any questions the Court raises.

We will explain each step in plain language and help you move the application forward at a pace that reflects the estate’s circumstances.
